How very unsexy! Imagine for a second that, at the conclusion of a wonderful date night, you turn to your beloved, look into their beautiful sparkling eyes, crane your neck in for a romantic kiss and WHAMO! Some alarm sounds indicating that it’s time to blow into the plastic tube sticking out of your dash board. Hold that thought honey! I’ve got to blow 1.5 liters of air into this tube first! Many sections of the NH DWI statute call for the installation of an Ignition Interlock System.
For a first offense DUI the court may require the installation of an interlock device. For an Aggravated DUI, 2nd Offense DUI and Subsequent DUI’s you will have the interlock device installed.
HOW THE INTERLOCK SYSTEM WORKS
The ignition interlock system, hardwired to your engine’s ignition system, can be set anywhere from a .00 BAC to slightly higher levels. When you are ready to drive, you reach past your hot date blow into a sensor on the dash board. If your breath alcohol content is over a certain limit the device will not allow the car to start.
At random intervals while the vehicle is in operation, the ignition interlock system will require breath samples from the vehicle operator in order for the vehicle to continue operating. This is called a “rolling test.” If the breath sample is not provided the unit records the occurrence and starts an alarm, such as horn blaring, lights flashing, etc. that will continue until the ignition is turned off.
The ignition interlock devices contain a computer chip that records your BAC content when you take the breath test. The report can be downloaded by interested parties.
CIRCUMVENTION OF AN INTERLOCK DEVICE
A person who is convicted of circumventing the interlock device will be guilty of a Class A misdemeanor. You will be required to pay a fine of at least $500 and required to install an “enhanced technology ignition interlock device and have the period of installation extended for two years.” The enhanced device has a camera and transmits data as events occur.
